Making a will is something that, because of the reason why we need to do it, is something that is easily put off - yet can lead to huge problems with probate if you don't write one in time.
Writing a last will and testament (to use the proper phrase for it) isn't as complicated as it used to be, and there are now many places online why you can write a legal DIY one!
Title : Williams on Wills Author : Sir William J. Williams Rating : 5 Stars out of 5. Summary : The best book of its kind
I cannot recommend this book too highly. It combines a full account of the law relating to wills with a volume of precedents covering virtually every common situation.
Title : The Law of Trusts and Equitable Obligations Author : Robert A. Pearce Rating : 5 Stars out of 5. Summary : Fantastic book
This book is fantastic. It is hard to find a book to recommend to students that has the depth of analysis necessary for a third year topic, but outlines the various rules and principles for a broad and accurate understanding of the application of trusts. Bear in mind that this is a text book, not a cases and materials book. It is clear, well expressed, detailed, and provides sufficient academic analysis to benefit the third year student. Diagrams are used to for those who learn visually, but are not intrinsic to the text, so can be ignored if the reader wishes. My students tend to favour this book above others. Negatives: Some chapters are a little over-long and the index is appalling.
Title : A Step-by-step Guide to Wills and Probate Author : A.K. Biggs Rating : 4 Stars out of 5. Summary : all the basics you need to knwo..
this is a good all round guide to drafting wills and dealing with the difficult task of what to do after a death in terms of winding up an estate. It doesn't go into very complex will drafting but in that instance as the book suggests you would really need to get a solicitor involved. However, it does allow you to draft most types of wills and certainly explains the proceedure following death in a clear and concise manner.
Title : Commentary and Cases on the Law of Trusts and Equitable Remedies Author : Joseph Arnold Nathan Rating : 5 Stars out of 5. Summary : The complete Trust textbook
Professor Hayton's book is the trust bible. It is thorough, challenging and will help develop an understanding of trusts which will be invaluable for the exam. If at times it is a difficult book it is only because trusts is a hard area of law. The great advantage of Hayton's book is that it is constantly predicting where the law is going and, given his influence in the world of equity, this is probably a self fulfilling prophesy! The materials are carefully selected and explained. I would recomend supplementing the book with another, such as Parker and Mellows. Hayton is infinitely more thought provoking but a lighter trusts guide will perhaps enable the reader to understand Hayton better. Having used Hayton all year I believe my mind has developed as a result of the book and I can appraoch the exams with confidence! Remember, there are no short cuts with trust law. This is not poncing around on the periphery with human rights and so forth but it is the cold black and white ink of the law. And no-one in the world knows more about trusts than David Hayton, so buy this book!
