Making a will is something that, because of the reason why we need to do it, is something that is easily put off - yet can lead to huge problems with probate if you don't write one in time.
Writing a last will and testament (to use the proper phrase for it) isn't as complicated as it used to be, and there are now many places online why you can write a legal DIY one!
Title : French Property and Inheritance Law: Principles and Practice Author : Henry Dyson Rating : 5 Stars out of 5. Summary : comments of john boyd qc
An excellent book for the practitioner and for those who take an informed interest in the subject.
The material is clearly set out and indexed. Though it deals with a technical subject it is expressed in a manner which can be understood by the layman.
UK lawyers and UK owners of property in France would be well advised to consult this book before embarking on a transaction. It is unlikely that a UK owner of property in France, or his UK lawyer, will get such helpful advice from any lawyer in France. I know of no other book which is so informative.
Title : Modern Equity Author : Harold Greville Hanbury Rating : 4 Stars out of 5. Summary : Excellent if you have to learn about this!
Having been recommended this book by my law tutor, it was never going to be a fascinating read. However, the broad narrative and the easy-ish to read text meant that taking notes was fairly simple. The definitive textbook for the student of the modern law of trusts.
Title : The Self-help Guide to Managing Death and Probate: Manage the Legal and Financial Side of Death Yourself Author : Gordon Bowley Rating : 3 Stars out of 5. Summary : Death Probate - Practical Comment
This book covers making executing/administering a will in England Wales (Note: This legal jurisdiction is important and unclear from the author's and amazon's description). As stated by others the pro-forma letters are useful. It is written in a style appropriate to its most common readers i.e. the recently bereaved, its easy to read and very inoffensive. Its good on probate wills, but weak on tax affairs (presumably to aid the books longevity).
I bought this book and found it useful when needing this knowledge.
Title : A Guide to Probate in Wisconsin Author : Pekowsky Rating : 4 Stars out of 5. Summary : I really don't care about camels but this was great!
I really couldn't care less about camels; But this isn't a boring book about camels. This is a book about a guy who loves Explorers. The spirit of exploration and the excitement of the unknown, drives the author and soon drives the reader. The guy is nuts to go into the desert of deepest China (especially at his age!) but you understand why he does it and by the end you will care about the camels too. It made me laugh out loud in places - but then you must have a sense of humour to do something like this!
Title : A Step-by-step Guide to Wills and Probate Author : A.K. Biggs Rating : 4 Stars out of 5. Summary : all the basics you need to knwo..
this is a good all round guide to drafting wills and dealing with the difficult task of what to do after a death in terms of winding up an estate. It doesn't go into very complex will drafting but in that instance as the book suggests you would really need to get a solicitor involved. However, it does allow you to draft most types of wills and certainly explains the proceedure following death in a clear and concise manner.
Title : Principles of Equity and the Law of Trusts (Principles of Law S.) Author : Alastair Hudson Rating : 3 Stars out of 5. Summary : Thorough but a little careless
You certainly except a book of this size to offer a very thorough account of the subject matter. Andrew Hudson does not dissappoint in this respect, His clear knowledge and clarity are a breath of fresh air for this student who tends to find that most law books are written by reseasrchers eager to impress their friends but not to help the student. Cavendish, the publishers are the exception to this trend, and despite being unfashionable as a result are certainly gasining popularity with the undergraduate market. Perhaps the only downside to this book, is the carelessness of teh editing. The subject matter is difficult enough without having to secong guess the writer. The book is certainly overpriced, but the difficulty in finding readable textbooks means this must be overlooked. Go and Buy it.
Title : Principles of Equity and the Law of Trusts (Principles of Law S.) Author : Alastair Hudson Rating : 1 Stars out of 5. Summary : Quantity not quality
This book is extremely poorly written and should only be read after you feel confident enough with your knowledge of the subject to be able to see all its innaccuracies, if at all. Reading this book provides a risk of wrongfully doubting your understanding of the subject. The major problems are that Hudson equates terms that mean different things (e.g. by beginning a paragraph saying a rule relates to beneficiaries but then using the term potential beneficiaries in its place without clearly stating that the rule applies to them as well) and an serious lack of structure that would especially confuse if this was the first book you read on the subject. Resist the temptation to buy the thickest and newest book and buy a quality book instead e.g. Hanbury and Martin's Modern Equity.
